Terms of Service

1. Acceptance of Terms

By accessing or using serversrus.net and the services provided by ServersRus Hosting ("ServersRus", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use our services.

2. Description of Services

ServersRus Hosting (trading as ServersRus) is an Individual Business registered in Trinidad and Tobago — Business Number B2026052000033, Business Identifier 6541585 — providing web design, development, hosting, domain management, email hosting, and related digital services to clients in Trinidad and Tobago and internationally.

Note: Clients who have signed a Service Agreement with ServersRus Hosting are governed by that Agreement, which takes precedence over these Terms in case of conflict. These Terms apply to general website visitors and prospective clients, and to existing clients where the Service Agreement is silent.

3. Account Registration

  • You must provide a valid email address and verify it to access paid features.
  • You are responsible for maintaining the security of your password and account.
  • You must be at least 18 years old to create an account.
  • One person may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use ServersRus services to:

  • Host malware, spyware, ransomware, or any malicious software
  • Conduct phishing, fraud, or any illegal activity
  • Send spam or unsolicited bulk email
  • Host adult content without prior written approval
  • Infringe on any third-party intellectual property rights
  • Attempt to gain unauthorized access to any system
  • Conduct denial-of-service attacks or abuse shared infrastructure
  • Host torrents or any content that facilitates copyright infringement
  • Violate any applicable law or regulation of Trinidad and Tobago or internationally

We reserve the right to suspend or terminate accounts that violate these policies without refund.

5. Payment & Billing

  • All fees are in Trinidad and Tobago Dollars (TTD) unless stated otherwise.
  • Accepted methods: bank transfer and cash only. International transfers are not accepted. Cash payments require a signed receipt — verbal confirmation is not accepted.
  • Receipts are issued within 48 hours of payment confirmation. The client must retain proof of all payments.
  • Monthly hosting fees are due on or before the 1st of each month. A seven (7) day grace period applies.
  • Late fee: after the grace period, a flat TTD $75.00 late fee per month applies, plus 3% simple monthly interest on the overdue balance until paid in full.
  • Build fees are non-refundable once work has commenced, regardless of reason.
  • Partial payments do not discharge the full obligation unless confirmed in writing. Payments are applied first to the oldest outstanding balance, then late fees, then current amounts.
  • Pricing changes apply with 30 days' written notice. Mid-contract increases require the client's written consent.
  • For paid Service Agreements: a 12-month minimum service commitment applies. Early termination triggers all remaining monthly fees for the unexpired term to become immediately due.

VAT Notice: All fees are currently exclusive of Value Added Tax (VAT). ServersRus Hosting is not currently VAT-registered under the Value Added Tax Act, Chapter 75:06 of Trinidad and Tobago. If registration becomes required (currently triggered at TTD $500,000 in annual taxable supplies), VAT at the prevailing rate will be added with 30 days' written notice.

6. Service Availability

We strive for high uptime but do not guarantee 100% availability. Paid plans include always-on hosting. Free plans are subject to inactivity sleep. We are not liable for losses caused by downtime, data loss, or service interruptions beyond reasonable control.

7. Data & Privacy

Your use of our services is also governed by our Privacy Policy. You retain ownership of all content and code you deploy. We do not access your application files except for support purposes with your explicit permission.

8. Termination

You may cancel your account at any time from your dashboard. We may suspend or terminate your account for violations of these Terms. Upon termination, your projects and data will be deleted within 30 days. We are not liable for any loss of data upon termination.

9. Limitation of Liability

To the maximum extent permitted by law, ServersRus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability to you for any claim shall not exceed the total amount paid by you to ServersRus in the 3 months preceding the event giving rise to the claim.

10. Dispute Resolution

Disputes are resolved through an escalating process:

  • Step 1 — Negotiation: good-faith direct negotiation within fourteen (14) days of written notice. Payment obligations are not suspended during a dispute.
  • Step 2 — Mediation: if unresolved, referral to mediation under the Mediation Act, Chapter 5:32 of Trinidad and Tobago. Costs shared equally unless otherwise agreed.
  • Step 3 — Courts: if mediation fails or is refused, proceedings before the courts of Trinidad and Tobago, which have exclusive jurisdiction.

ServersRus Hosting reserves the right to seek immediate injunctive or equitable relief to prevent irreparable harm, including breach of confidentiality, IP misuse, or non-payment of undisputed sums.

11. Governing Law

These Terms are governed by the laws of the Republic of Trinidad and Tobago, including the Electronic Transactions Act Chap. 22:02, the Computer Misuse Act Chap. 11:15, the Data Protection Act No. 13 of 2011, the Value Added Tax Act Chap. 75:06, the Mediation Act Chap. 5:32, and applicable common law principles of contract.

12. Changes to Terms

We may update these Terms from time to time. Updates are posted on serversrus.net with the effective date. Updates do not alter the terms of any existing signed Service Agreement without the Client's written consent. Continued use of the website after an update constitutes acceptance for general browsing purposes.

13. Entire Agreement

These Terms, together with our Privacy Policy and any signed Service Agreement, constitute the entire agreement between you and ServersRus Hosting regarding our services and supersede any prior agreements.
